Terms & Agreements
This Terms & Agreements document is drafted in accordance with mandatory European Union consumer protection legislation, including Directive 2011/83/EU and Directive (EU) 2019/771, and applies to consumers within the European Union.
1. General Terms
These Terms & Agreements apply to all orders placed by the customer (hereinafter referred to as the “customer”, “you” or “consumer”) with the owner of the CATACLLYSM.COM website (hereinafter referred to as “CATACLLYSM”, “we” or “us”).
By accessing CATACLLYSM.COM and/or placing an order, you enter into a legally binding distance sales contract and agree to be bound by these Terms.
Only natural persons aged 18 or over, acting as consumers (not legal entities), and having a delivery address within the European Union may place orders.
Nothing in these Terms limits or excludes your statutory rights under applicable EU consumer protection law. In the event of any conflict, mandatory EU consumer law shall prevail.
2. Product Availability
The inclusion of products on CATACLLYSM.COM does not guarantee their availability. Product availability is indicated on the website; however, exceptional situations may occur due to technical errors or simultaneous orders.
CATACLLYSM reserves the right to modify, suspend or discontinue products or services at any time without prior notice.
3. Placing Orders & Contract Formation
Orders may be placed exclusively through CATACLLYSM.COM.
A legally binding contract is concluded only when you receive an order confirmation email from CATACLLYSM.
CATACLLYSM reserves the right to refuse or cancel orders for legitimate reasons, including but not limited to:
product unavailability,
technical or pricing errors,
suspected fraud,
abuse of consumer rights.
Where payment has already been made, any refunded amount will be returned without undue delay using the same payment method, unless otherwise expressly agreed.
4. Prices & Delivery Fees
All prices displayed on CATACLLYSM.COM include VAT applicable under EU law.
Delivery costs are displayed separately during the checkout process before the order is confirmed.
If an order is delivered in multiple shipments, no additional delivery fees will be charged.
5. Payment Methods
Payments are accepted by credit or debit card (VISA and Mastercard).
The total amount may be pre-authorised at the time of order placement and debited upon dispatch of the goods.
Any bank or transaction fees charged by your payment provider shall be borne by the customer.
CATACLLYSM reserves the right to verify card validity, billing information and solvency and may refuse orders based on the outcome of these checks.
6. Limitation of Liability
Nothing in these Terms shall limit or exclude CATACLLYSM’s liability where such limitation or exclusion would be unlawful under applicable EU law.
CATACLLYSM shall not be liable for indirect or consequential losses, including but not limited to loss of profit, loss of opportunity or reputational damage.
Our total liability in connection with any order shall not exceed the total amount paid for that order.
CATACLLYSM shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, pandemics, governmental actions or technical failures.
7. Abuse of Rights
Where a customer engages in repeated or systematic conduct that exceeds normal consumer behavior — including excessive or abusive use of the right of withdrawal — CATACLLYSM reserves the right to apply proportionate and justified measures, such as:
refusing future orders,
restricting access to services,
suspending or closing the customer account.
Such measures shall be applied in compliance with EU consumer protection law and the principle of proportionality.
8. Governing Law & Jurisdiction
These Terms are governed by mandatory European Union consumer protection legislation and, where applicable, by the mandatory laws of the consumer’s country of residence.
Consumers may bring legal proceedings in the courts of their place of domicile.
9. Statutory Rights
Nothing in these Terms limits or excludes your statutory rights under applicable European Union consumer protection law.
